Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
Effective January 4, 2010, the U.S. Department of Health and Human Services, Center for Disease Control and Prevention (HHS/CDC) is removing HIV from the list of communicable diseases of public health significance and references to HIV from the scope of medical examinations for foreign nationals.
Until the rule goes into effect, non-citizens who are HIV-positive cannot be admitted into the U.S. unless the U.S. Department of Homeland Security (DHS) grants a waiver. Once the rule goes into effect on January 4, 2010, HIV infection will no longer be defined as a communicable disease of public health significance, immigrant visa applicants who are required to undergo a medical screening exam will no longer be tested for HIV, a waiver for entry into the U.S. will no longer be necessary, and HIV-positive visa applicants will not be found ineligible for visas under Section 212(a)(1)(A)(i) of the Immigration and Nationality Act (INA). Although foreign nationals with HIV who apply for visas will no longer be ineligible under INA Section 212(a)(1)(A)(i), they still must overcome the public charge under INA Section 212(a)(4) by demonstrating to the consular officers that they will have the means of support in the U.S. and that they will not need to seek public financial assistance. Bush said he wants to improve the working visas, I think the prority needs to offer to Canadians because Canadinas use the same language and education system, the distance is closer. We need to call all the senetors, the working visas.etc. need to go to Canadina citizens first.

Yes, delete the background layer and it will give you a transparent background (or you can just start a new image with the transparent background.

i was working with employer A (h1b tenure 2006---september 30 2009)...I applied for my extension and also transfer of h1b to company B..got h1b extension sucessfully from 09-2009 to 08/2012...
both the companies A and B are operated by same person..
I went for H1B stamping in november 2009 at Canada ottawa...in the mean time my employer has same adress for company A and company B..My employer has provided me a letter stating that company B has merged with company A so they have same address
The visa officer has found out that they share the same adress and questioned me what is the point of H1B transfer when they share the same adress and both the companies are merged and he refused my h1b visa..
My employer sugessted me to attend again the interview at the newdelhi consulate ..he has provided me the business license ,office land purchase documents and companies merging document...which i have submited to newdelhi consulate..
after 3 months the new delhi consulate sends me a visa denial letter
stating that
we are not able to issue you a visa because:
your petitioner doesnot either be able to provide qualified employment in USA
I129 petition filed on your behlaf has been submitted to USCIS...
My original I797 was returned to me at the time of interview
my question:
Can I apply for a H1B transfer and attend interview again for stamping as I have original I 797???
WHAT OTHER OPTION DO I HAVE...

I am planning to schedule a visa appointment soon. I was filling DS-156 form
and have a following question:
Item#36 : "Has anyone ever filed an immigrant visa petition on your Behalf?".
Here is my situation:

Myself -> H1B
My wife, kid -> H4
Applied for I-485 last year ( all 3 of us ).
Question:
For me, I understand that I say "yes" and mention name of my employer.
But for my wife+kid, I say "yes", but what should I fill for "who" part?
Also, Item#33 for my kid (2nd grade), should answer to "Do you intend to study
in US" be YES or NO ? ( my guess is YES, and name of the elementary school?)

Any cases where the underlying I-140 was withdrawn after 180 days of the 485 being pending(changed jobs using AC21) got approved recently?

If the I-94 was not given a full year's validity due to passport expiring within a year, Is the I-94 still valid after its expiry?
As far as I-94 goes it will expire but since you are already in AOS status, it really does't matter.

I only know information about I-485 filing but do not know what to expect after it is filed?
Can someone tell me what to expect after things are in place? Like expecting Receipt date, fingerprinting - how many of them, what to look for and what to watch out for etc. A consolidated discussion may help many who are unaware of the system.
Who will get such information, lawyer or the applicant?
In normal circumstances (without the floodgates open) you would get a receipt within 2-3 weeks after the application is submitted. Fingerprinting happens soon after (still within a month). Then you get an EAD first, then the AP. In all this your lawyer will be informed as well as you. Sometimes your lawyer gets to hear first b4 you.
...Wait for approval of i-140 depending on date they are processing at NSC. Hope this helps. this is my 2 cents

As far as I know, any person can stay in US legally only on one visa at any point of time. That said, the moment you switched to L1, your H1 is invalid. I'm pretty sure that you can't use your previous H1 extension and you have to file for new H1 petition which starts in April 2008.

As a H1B holder, can I start a new company and volunteer for it while I am holding a full-time job for the company that sponsors me the visa? I am expecting the new company to gain a profit, of course.:)
